Terms of sale
The owner of the online shop GEAL (hereinafter referred to as the Online Store) is Kollane Disain OÜ (registry code 14054590), located at Pirni tn 5, Tallinn 10614.
Term of sales contract and information about validity, goods and prices
The terms of sale apply to purchasing goods from the Online Store.
The prices of the products which are being sold in the Online Store are indicated next to the products. A fee for delivery of the goods is added to the price.
The fee for delivery of the goods depends on the location of the buyer and the delivery method. The delivery fee is displayed to the buyer when the order is placed. Information about the goods is provided in the Online Store next to the goods.
If the order has not been paid within 3 working days from the time of ordering then the order will be cancelled.
The order placed on the weekend will remain on Monday.
The final prices of the product are all in euros, plus shipping costs according to the price list provided before purchasing the product.
When ordering goods from outside of the European Union, like import-related taxes, VAT and if necessary, customs duties – they are paid by the buyer. Before making a purchase, please make sure what are the possible tax liabilities.
The necessary information (product description, maintenance) about the products is provided in the Online Store directly next to the products.
PLACING AN ORDER
For ordering, the requested products should be added to the shopping cart. To finalise the order, the required data fields should be filled in and then choose a suitable means of delivery. The total price is then displayed on the screen, which can be paid via a bank link (Kollane Disain OÜ, LHV Pank EE18770077100204877) or using PayPal.
The contract enters into force after the amount of payment has been credited to the bank account of the Online Store. If it is not possible to deliver the ordered goods due to lack of stock or another reason, the buyer will be notified as soon as possible and the cost paid (including delivery fees) will be refunded usually within 1-2 working days. Depending on the method of payment, the refund may take up to seven working days.
Kollane Disain OÜ has the right to change these conditions and prices. These changes do not apply at the time of ordering. By placing an order from the Online Store, the buyer confirms that he/she has agreed to the terms of sale.
N.B: All products are handmade. When a suitable product is out of stock at the time of ordering, it is possible to order it again. This means that the ordering time might vary between 2-6 weeks. The time depends on the product itself and the availability of the material.
In addition to the terms of sale, the legal relations related to the use of the Online Store are regulated by the legislation of the Republic of Estonia.
If possible, the goods will be sent to all countries. Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method. N.B: The cost of transport outside Estonia may also depend on the dimensions of the product.
In Estonia, parcels will normally arrive at the location specified by the buyer within 3-7 working days of entry into force of the sales contract. Outside Estonia, goods are usually delivered within 1-5 weeks.
It is also possible to pick up the product by yourself at Pirni tn 5, Tallinn, by prior arrangement.
Delivery to Europe is within 5-9 working days and the rest of the world is up to 5 weeks. If the Online Store has notified the buyer of delivery problems and a term exceeding 30 calendar days on their website or in the order confirmation, the term specified by the Online Store applies.
When the ordered parcel is being sent out, the customer will be notified by e-mail (parcel tracking code) or if possible, can choose the time when to pick it up.
RIGHT OF WITHDRAWAL
After receiving the order, the buyer has the right to withdraw from the contract entered into with the Online Store within 14 days The right of withdrawal does not apply if the buyer is a legal person. With the 14-day right of withdrawal, the buyer may not use the ordered goods in any other way than is necessary in order to examine the nature, properties and functioning of the goods in the same way the buyer would be allowed to test the goods in a physical shop. The product must not be damaged, for example with holes, scratches, stains etc that has damaged the appearance of the product is no longer marketable. The product must be in the same condition as it was shipped to the buyer. The damaged product will be returned to the buyer.
If the products have been used in any other way than is necessary for the nature, characteristics or functionality of the goods or they have wear marks, the Online Store has the right to reduce the refundable amount in accordance with the decrease in value of the goods. In order to return the product, the buyer should submit a withdrawal application and send it via e-mail no later than 14 days of receiving the product.
The costs of returning the products will be borne by the buyer, unless the reason for return is the fact that the item being returned does not correspond to what was ordered (e.g. an incorrect or defective item). The buyer should return it within 14 days of submitting their application to do so or provide proof that the goods have been handed over to the carrier within that period.
When returning the product, a purchase invoice of a product must be accompanied.
Having received the returned goods, the Online Store refunds the buyer any amounts received from the buyer on the basis of the contract immediately but no later than within 14 days of receiving the application for withdrawal.
The Online Store may refuse to process the refund until it receives the item that is the object of the contract or until the buyer submits proof that the item has been sent back, whichever happens first.
If the buyer has explicitly chosen a method of delivery different from the most inexpensive normal method of delivery offered by the Online Store, the Online Store is not required to refund to the consumer the amount exceeding the cost of normal delivery.
The Online Store has the right to withdraw from the sales transaction and request that the products should be returned by the buyer if the marked price of a product in the Online Store is significantly lower than the market price of the product due to an error.
RIGHT TO FILE A COMPLAINT
The Online Store is liable for the non-compliance of the goods sold to the buyer with the terms and conditions of the contract or for the defects which existed at the time of delivery of the item and which become evident within up to two years of the delivery of the goods to the buyer. Within the first year after the item was delivered to the buyer, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the Online Store to disprove this.
In the event of a defect, the buyer has the right to contact the Online Store no later than within two months by sending an e-mail to firstname.lastname@example.org.
The Online Store is not liable for defects that have occurred due to the consumer’s action or inaction (incorrect use, an accident, etc.) after the goods were delivered or in the case of normal wear and tear caused by normal use of the item.
If the goods that are purchased in the Online Store have defects for which the Online Store is liable, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees incurred under the sales contract to the buyer.
The Online Store will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.
The two-year warranty from the date of purchase, does not apply if the defects are due to misuse, damage of the product and by wear and tear. In the event of a claim, the product must be accompanied by an invoice or proof of purchase. If it is not possible to repair or replace the product, the buyer will be informed by e-mail and the money will be refunded as soon as possible, but not later than 30 days from the date of return of the product.
In addition, the guarantee does not apply to the goods that are marked as "with defect" or "sample". These corresponding goods have a substantially reduced selling price.
N.B: To prevent the defect from worsening, please do not continue to use the defective product but contact us immediately by sending an email to email@example.com.

Kollane Disain OÜ reserves the right to correct inadvertent errors or misinformation.
Due to computer displays, the colours of the product in the photos may differ from reality.
Re-using and copying information, text and images from the Kollane Disain OÜ Online Store without the written consent of the author is prohibited.
PROCESSING OF PERSONAL DATA
The chief processor of personal data of the GEAL´s Online Store is Kollane Disain OÜ (14054590) located at Pirni tänav 5, in Tallinn, e-mail firstname.lastname@example.org.
WHICH PERSONAL DATA IS BEING PROCESSED
• name, telephone number and e-mail address;
• delivery address;
• bank account number;
• the cost of goods and services and the data related to the payments (purchase history)
IN WHICH PURPOSE THE PERSONAL DATA IS BEING PROCESSED
Personal data is only being used to manage the customer orders and to deliver the packages. The bank account number is being used if the payments need to be returned to the customer. Personal data such as e-mail, telephone number and customer´s name are being processed to resolve issues related to the provision of the goods. E-mail is being used to send invoices and the telephone number is being used to notify the goods that have arrived at the parcel machine.
The purchase is made without a user account. Direct marketing notifications will not be sent.
THIS ONLINE STORE IS USING FOLLOWING COOKIES:
• session cookies with the purpose to enable the use of the Online Store;
• persistent cookies with the purpose to remember the customer's choices in the Online Store;
• first-party and / or third-party cookies with the purpose to display personalized advertising and offers for the customer.
• Third-party analysis cookies with the purpose to optimize marketing communications.
In addition to the use of analysis cookies, the Online Store is also using pixels (pixel tags, web-beacons) to monitor the use of the seller's website. In doing so the identifiable information will not be processed.
The processing of personal data is taking place for the purpose of filling the contract concluded with the customer (management of the customer's orders, delivery, return of goods and payments). The processing of personal data is carried out in order to fulfill a legal obligation (eg accounting).
Kollane Disain OÜ does not disclose the buyer's data to third parties except for transport service providers to deliver the order to the buyer and when paying for purchases via PayPal (the name of the payer and the purchase amount). When the package is being sent to parcel machine, it is necessary to know the name and the phone number to whom to send (you can choose the specific parcel machine that is nearest to you to pick it up). When the goods have arrived in the parcel machine, your phone number will receive the notification. When sending via a post office, then the destination address is also needed to send the package out.
The purchase is made without a user account therefore the personal data can be found out more via customer support. If the request for access to personal data is submitted electronically then the information will be also provided back by publicly available electronic means.
After the completion of the order-related process: the above personal data and / or order-related information will be deleted, except for personal data (purchase history data) that needs to be retained for accounting or to resolve consumer disputes.
Since it is only possible to order from this Online Store without a customer account therefore the purchase history will be stored for three years.
In the case of payments and customer disputes, personal data is being kept until the claim is fulfilled or the limitation period expires.
For accounting purpose the personal data is required to keep for seven years.
The customer has the right to request the restriction of the processing of his/hers personal data if the data is inaccurate or incomplete or if the personal data is being processed unlawfully.
The supervisory authority is the Estonian Data Protection Inspectorate (email@example.com).
The disputes related to the processing of personal data are being resolved through customer support firstname.lastname@example.org. If the buyer and the Online Store are unable to resolve the dispute through an agreement, the buyer can turn to the Consumer Disputes Committee. The terms and conditions of the procedure can be found at https://ttja.ee/tarbijavaidluste-komisjon.
The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between the buyer and the Online Store. The examination of the buyer's complaint by the Commission is free of charge.
The buyer may refer to the European Union's consumer dispute resolution platform.
The reply to the buyer's questions will be provided as soon as possible, but not later than within 30 days.
